SimplySign provides a free electronic signature platform that allows users to create, share, and sign legally binding contracts online. The Service includes contract creation, magic link email delivery, multi-party signing, and cryptographic verification.

3. Electronic Signatures

Electronic signatures created through SimplySign are intended to be legally binding in accordance with:

  • The Electronic Signatures in Global and National Commerce Act (ESIGN Act) in the United States
  • The Uniform Electronic Transactions Act (UETA)
  • eIDAS Regulation in the European Union
  • Similar electronic signature laws in other jurisdictions

Each signature captures IP address, timestamp, and browser information to establish authenticity and non-repudiation.

4. User Responsibilities

By using our Service, you agree to:

  • Provide accurate and complete information
  • Use the Service only for lawful purposes
  • Not impersonate another person or entity
  • Not use the Service to create fraudulent or illegal contracts
  • Not attempt to gain unauthorized access to the Service
  • Not upload malicious content or code
  • Ensure you have the legal authority to enter into contracts
  • Obtain consent from all parties before adding them to a contract

5. Prohibited Uses

You may not use the Service for:

The Service and its original content, features, and functionality are owned by SimplySign and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any contracts and content you create using the Service.

7. Privacy and Data Protection

By using the Service, you consent to the collection and use of information as described in our Privacy Policy. We comply with GDPR, CCPA, and other applicable data protection regulations.

8. Contract Storage and Retention

We store your contracts securely on our servers. While we take reasonable measures to ensure data integrity and availability, you are responsible for maintaining your own records and backups of important contracts.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT PROVIDE LEGAL ADVICE AND RECOMMEND CONSULTING WITH A QUALIFIED ATTORNEY FOR SPECIFIC LEGAL QUESTIONS REGARDING YOUR CONTRACTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPLYSIGN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless SimplySign and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.
